How To Write Legal Studies Term Papers

The following article provides a brief synopsis on one of the domains of the legal studies, known as the critical legal studies. By the term “legal”, it is evident that the concerned domain is related to a theory or a movement, which is established upon law, official or accepted rules and regulations. The discipline of legal studies comprises of the decrees, which are formulated in order to maintain the regime in the country and eliminate the traces of injustice. However, the politicians to sustain their chain of command may also use them.

The nitty-gritty of the Critical Legal Studies (CLS) movement was brought into being in the year 1960 on the occasion of the participation of individuals in the social policy that was meant to achieve goals through direct or militant action during the Vietnamese War. The erudite scholars of the following era had begun employing diversified theories to the field of law and made enormous contribution in reshaping the discipline of legal studies.

However, the legitimate appearance of the legal studies movement was observed in the year 1977 at a conference being held at the University of Wisconsin-Madison. The CLS movements were on an increase during 1980s in the United States. However, the British or the European CLS did not succeed in gaining its aimed targets except for the Finnish international lawyer Martti Koskenniemi, who had played a significant role in the Critical Legal Studies campaigns.

Some of the other remarkable scholars and theorists who contributed to a great extent towards the legal studies movements were Karl Marx, Friedrich Engels, Herbert Marcuse, Michael Foucault, etc.

The sphere of the Critical Legal Studies (CLS) encompasses a number of domains including the feminist legal theory, critical race theory and post modernism. One of the recently introduced field of legal studies is the Islamic Legal Studies Program (ILSP) which has been founded by the Harvard Law Schoolin 1991. The principal aim behind its establishment is the promotion of the Islamic laws and creating awareness amongst the Muslim and the Non-Muslim masses regarding the significance of the Islamic legal system. Various scholars and erudite intellectuals from all over the world are chipping in the Islamic Legal Studies Program (ILSP), thus leading to the promulgation of the Islamic laws in the Eastern and the Western parts of the world.

The Critical Legal Studies (CLS) operations were founded upon a number of themes, some of which are discussed in the article. One of the most significant motifs of the Critical Legal Studies revolved around the theory which stated that the conclusion of the legal clashes or differences of opinions can not be ascertained with the help of the legal materials alone.

The second most significant part is the association of politics with laws. According to a theory, “all law is politics.” Some scholars had held the view that political verdicts are more or less analogous to the legal judgments. On the contrary, the modern day theorists presume that the proposed theory sheds light on the trait of the issues that arise while resolving the political and legal issues while the proposition is not based on the workable stratagems.

Several people put forth a claim that there are certain laws and commandments that are aimed at supporting the authoritative individuals, causing harm to the weak. However, the present-day literary figures strongly condemn the particular claim and hold the view that the laws can never serve as the tools for bias or discrimination.

In spite of all the claims made against the laws and an extensive criticism against the legal studies movements, they continued to exhibit rapid advancements involving the outstanding academicians all over the world.
